Does bankruptcy in Washington D.C. help with a suspended license?

If you lost your driver’s license in Washington, D.C., because of a criminal activity such as a traffic violation, filing for bankruptcy will not have any effect on the suspension. However, if your license was taken away because you were unable to pay fees for a violation or the damages associated with an accident, you might find good recourse through filing for Chapter 7 bankruptcy.

Many drivers lose their licenses due to a moving violation they cannot afford. As the Washington, D.C., Department of Motor Vehicles points out, your license may be reinstated once you have paid a ticket.

You may be aware that a Chapter 7 bankruptcy discharges your debts, such as the following: 

  •        Credit card debt
  •        Past due utility bills
  •        Medical bills
  •        Some civil court judgments

Traffic fines are not dischargeable through a Chapter 7 bankruptcy. In fact, no fines or penalties that you owe to a government entity will be. However, through eliminating other debts, you may be able to free up the money necessary to pay off your ticket and get your license reinstated.

You may also want to consider filing for a Chapter 13 bankruptcy, because certain civil fines and penalties can be discharged through this option. It is important that the fine is not classified as criminal, because those types of assessments cannot be eliminated. Even if the money you owe cannot be discharged through Chapter 13, you may be able to develop a repayment plan that would enable you to get your driver’s license back.
